1. Agreement to Terms

By accessing or using Rootnotes ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Rootnotes is a plant care journal Progressive Web Application (PWA) that allows users to log care activities, store photos, track the health and growth of their plants, and interact with an AI plant companion. The Service is accessible through modern web browsers and can be installed on your device.

3. User Accounts

To use the Service, you must sign in using a supported OAuth provider (currently Google). You are responsible for all activities that occur under your account. We do not store passwords — authentication is handled entirely by the OAuth provider.

You agree to:

  • Provide accurate and current information during sign-in
  • Maintain the security of your OAuth-linked account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Collect or store personal data about other users without consent
  • Use the Service for any commercial purposes without our express permission
  • Abuse API endpoints or attempt to circumvent rate limits

5. User Content

You retain full ownership of any content you submit, post, or display through the Service ("User Content"), including photos, notes, journal entries, and plant information.

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing the Service to you. We do not use your content for advertising, training, or any purpose other than delivering and improving the Service.

You are solely responsible for your User Content and represent that you have all necessary rights to submit such content.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Rootnotes and its licensors. The Service is protected by copyright, trademark, and other applicable laws.

7. Free Tier & Paid Plans

The Service may offer both free and paid subscription tiers. The free tier provides core functionality with certain limitations (such as a maximum number of plants). Paid plans unlock additional features and higher limits.

We reserve the right to modify the features available on any tier, introduce new tiers, or change pricing with reasonable advance notice. Changes to paid plans will not affect the current billing period.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

You may delete your account at any time through the Service settings. Upon account deletion, your data will be permanently removed in accordance with our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. Plant care suggestions, reminders, or information provided through the Service — including from the AI plant companion — are for informational purposes only and should not be relied upon as professional horticultural, botanical, or agricultural advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROOTNOTES, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Loss of plants or property resulting from reliance on information provided by the Service

11. Indemnification

You agree to defend, indemnify, and hold harmless Rootnotes and its licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France and the European Union, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in France.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rootnotes regarding the Service and supersede all prior agreements and understandings.
